Terms & Conditions

These Terms & Conditions describe the general policies that apply to commissioned animal and pet portraits by T.Love Fine Art. The specific details of each commission will be outlined in an individual Commission Agreement.

1. Commissions & Pricing

Standard portrait pricing is based on the sizes and options listed on the Commissions page. The final price for each commission will be confirmed in the individual Commission Agreement before work begins.

Once the Commission Agreement has been signed and the deposit has been received, the agreed price will remain in effect for the scope of work described in the agreement.

Requests that change or expand the agreed-upon scope of a commission may result in an additional charge.

2. Payment & Deposit

A 50% non-refundable deposit is required to reserve a commission and begin work.

The remaining 50% balance is due when the portrait is completed and before the finished artwork is released for pickup or shipping.

A commission is not considered reserved until the signed Commission Agreement and required deposit have been received.

3. Changes & Additional Requests

The client will have an opportunity to discuss the portrait specifications, composition, size, and other details before the Commission Agreement is signed.

Once work has begun, requests that require significant changes to the agreed-upon composition, subject matter, size, or other specifications may result in an additional charge.

Any additional cost will be discussed with the client and approved before the additional work is completed. Additional requests may also affect the estimated completion date.

Minor artistic decisions made during the creation of the portrait, including adjustments to detail, shading, color, texture, or other elements necessary to complete the artwork, are part of the artistic process and do not constitute a change to the commission.

4. Reference Photos & Artistic Interpretation

The client is responsible for providing reference photographs that they have permission to provide for use in creating the commissioned artwork.

The artist uses the provided photographs as the basis for the portrait while making artistic decisions regarding interpretation, composition, color, detail, texture, and technique.

Because each portrait is individually created by hand, the finished artwork may not reproduce the reference photograph exactly.

5. Cancellation

If the client cancels the commission after the deposit has been paid, the 50% deposit is non-refundable.

If work has already begun, any completed or partially completed artwork remains the property of the artist unless otherwise agreed in writing. The remaining balance is not due unless otherwise specified in the individual Commission Agreement.

If the artist becomes unable to complete a commission, the artist will notify the client and arrange an appropriate resolution, including a refund of payments received for work that has not been completed, as applicable.

6. Completion & Timeline

Estimated completion times will be discussed when the commission is arranged. Completion time may vary depending on the size and complexity of the portrait, the artist's schedule, and any additional requests made during the process.

The artist will make reasonable efforts to complete the portrait within the estimated timeframe but does not guarantee an exact completion date unless specifically stated in the Commission Agreement.

7. Shipping & Delivery

If the finished artwork is shipped, all shipping and delivery costs are the responsibility of the client. Shipping arrangements and estimated costs will be discussed before the artwork is shipped.

The remaining balance must be paid in full before artwork is released for pickup or shipping.

8. Framing

Framing is not included in the portrait price. The artist is happy to provide general guidance regarding framing options for the finished artwork.

9. Ownership & Copyright

The original artwork becomes the property of the client once the commission has been paid in full.

Copyright and reproduction rights remain with the artist unless otherwise agreed to in writing. Purchasing an original commissioned artwork does not transfer copyright or reproduction rights to the client.

The artist retains the right to photograph and document commissioned artwork, including work in progress and completed artwork, and to display such images for the artist's portfolio, website, social media, exhibitions, and promotional purposes.

10. Reference Photos & Client Privacy

Reference photographs provided by the client are used as reference material for creating the commissioned artwork. The artist will not sell or distribute the client's reference photographs.

If a client has specific privacy concerns regarding the display of the completed commissioned artwork, those concerns should be discussed before the Commission Agreement is signed.

11. Commission Agreement

The individual Commission Agreement will identify the specific details of each commission, including the client, animal(s), portrait size, price, reference photos, and any agreed-upon special requests.

The signed Commission Agreement governs the specific commission and may include terms that differ from these general Terms & Conditions.
